You're responsible for the accuracy of your account information, for the activity under your account, and for keeping your credentials secure. Access to features is governed by the role assigned to you by your venue or organization.
3. Operator responsibilities & participant data
If you use the Services to run a venue, league, or program (an "Operator"), you are responsible for the information you collect from your participants and for having a lawful basis to collect it — including obtaining verifiable parental consent for children's information as required by COPPA and applicable law, and providing any required privacy notices. You will only upload information you're permitted to, and you'll honor participants' privacy rights. Our handling of information is described in our Privacy Policy.
4. Payments & fees
GameDay OS does not process payments. Registration fees and similar charges are collected by Operators through their own payment providers; we never take custody of those funds. Fees you owe us for the Services (for example, a venue subscription) are billed separately, typically by invoice or purchase order, on the terms stated in your order or agreement.
5. Acceptable use
- Don't use the Services to break the law, infringe others' rights, or harm minors.
- Don't attempt to breach security, access data you're not authorized to, or disrupt the Services.
- Don't misuse another organization's or participant's data.
- Don't resell or provide the Services to third parties except as expressly permitted.
6. Your content & the record
You (and your Operator) retain ownership of the information and content you put into the Services. You grant us the rights needed to host, process, and display that content to operate the Services for you. Where the Services let a family carry a portable record across seasons and teams, that record remains subject to the family's sharing choices and our Privacy Policy.
7. Our intellectual property
The Services, including our software, design, and trademarks, are owned by GameDay OS and its licensors. These Terms don't grant you any rights to our intellectual property except the limited right to use the Services as permitted here.
8. Third-party services
The Services may connect to or reference third-party tools (for example, streaming, scoreboards, or a league's payment provider). We're not responsible for third-party services, and your use of them is governed by their terms.
9. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any weather, safety, or operational information will be accurate or timely. You are responsible for your own safety and operational decisions.
10. Limitation of liability
To the maximum extent permitted by law, GameDay OS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the [12] months before the event giving rise to the claim.
